Expungement is the legal process of removing a criminal charge or conviction from your record under North Carolina law. Once expunged, you can lawfully state on most job applications, housing forms, and professional license applications that the offense never occurred.

North Carolina law (G.S. Chapter 15A, Articles 5 & 5A) provides expungement pathways for dismissed charges, first-offense misdemeanors, certain drug offenses, and some felonies. NCEAT℠ helps you find out which path fits your situation — and what it costs to get there.

Eligibility Overview

NC Expungement Categories

NC law provides several expungement pathways. NCEAT℠ screens for all of the following.

G.S. § 15A-146

Dismissal or Acquittal

Case dismissed or found not guilty. No waiting period. Strongest eligibility — file immediately.

G.S. § 15A-145

First-Offense Nonviolent Misdemeanor

No prior convictions. Sentence must be complete. One-time expunction available.

G.S. § 15A-145.2

Drug Offense — Conditional Discharge

First offense. Discharge period completed. No prior drug conviction or prior expunction.

G.S. § 15A-145.5

Nonviolent Felony (First Offense)

Specific felony classes only. 10-year waiting period post-sentence completion.

G.S. § 15A-145.5(c)

Multiple Nonviolent Offenses

Same session of court only. 10-year waiting period. Max 3 offenses. No violent charges.

G.S. § 15A-145.6

Victim of Human Trafficking

Offenses connected to trafficking status. No waiting period specified by statute.
